GENERAL TERMS AND CONDITIONS OF SALE
Amélie Studio
The following general terms and conditions of sale must be carefully reviewed by the Customer before completing the purchase process. By placing an order through the website www.ameliestudio.it, the Customer acknowledges full and absolute knowledge of these terms and conditions and their complete acceptance.
1. Premises and Definitions
These General Terms and Conditions of Sale govern: (a) the purchase of ready-to-ship products (paintings, prints, and other works) from "Amélie Studio" through the website www.ameliestudio.it
(hereafter referred to as the "Site"), and (b) the creation, production, and sale of commissioned artworks (paintings, illustrations, sculptures, digital works, etc.) created by Amélie Gaët (hereafter referred to as the "Seller" or "Artist"), by an individual who purchases and commissions the work for personal, non-professional use (hereafter referred to as the "Customer" or "Commissioner").
2. Order Procedure and Confirmation
For ready-to-ship products, the Customer's order constitutes an offer to purchase. Upon receipt of the order, the Seller will send an email to the Customer containing the order number, information about the products ordered, the breakdown of prices for each item, shipping address, payment methods, and estimated delivery costs and times. This email constitutes the Seller's acceptance of the Customer's purchase offer under the terms indicated in the email itself. Shipping of products is subject to payment.
For commissioned artworks, the Commissioner requests an initial quote from the Artist through the Site or by direct email, specifying:

Desired completion timeframe
Concept/topic requested
The Artist will send a proposal containing the price, specifications, and estimated completion time, along with a draft for approval. At that point, the Commissioner formally commissions the Artist via email. The commission is considered accepted by the Artist, according to the specifications agreed upon electronically, only after receiving written confirmation from the Commissioner and payment of a deposit. The Commissioner acknowledges that the commissioned artwork falls under customized goods as defined by Article 59, paragraph 1, letter c) of the Consumer Code.
3. Prices and Payment
Prices are fixed in Euros and include VAT, where applicable.
The Customer may pay via credit card, active PayPal account, or bank transfer (to an IBAN provided to the Customer at the time of the order).
Accepted credit cards include:
Visa/Visa Electron
Mastercard
American Express
Maestro International
To make a payment by credit card, the Customer will receive a payment link and must follow the instructions provided on the Site and/or by the Customer's Bank (for which "Amélie Studio" has no control or responsibility).
The total amount of the order is charged to the Customer's credit card or PayPal account when the order is submitted to the Seller (when the Customer selects "Buy"), with the Seller's simultaneous acceptance as per Article 2 of these Terms and the initiation of the product preparation for shipment.
For security reasons, payments made via the website www.ameliestudio.it
are processed by the bank managing the Customer's credit card, which is responsible for securely handling and processing the payment details in a protected environment.
For payment, the Customer must:
If paying by credit card, confirm the cardholder's details through the Site, providing the 16-digit card number, expiration date, and the security code.
If paying through PayPal, enter the required login details on the PayPal page and complete the payment as instructed by the service provider.
During the purchase process, the Seller will store a recognition code linked to the Customer’s PayPal account, authorizing its exclusive use for future purchases or exchanges of previously purchased goods, so that the Customer will not need to re-enter PayPal login details. The Customer can revoke this authorization at any time through their "My Account" page, by request to Customer Service, or directly through their PayPal account. PayPal may require the Customer to re-enter their login credentials if there is suspicion of unauthorized activity related to their PayPal account.
The order process is considered complete once payment is confirmed and the Customer is redirected to a page on the Site confirming the order acceptance.
If payment cannot be processed due to incorrect data entry by the Customer or technical issues, the Customer will not be able to complete the order. If the Customer decides to abandon the payment page, they will be redirected to a page indicating that the order could not be completed.
For commissioned artworks, the payment will be divided as follows:
30% deposit upon order confirmation
Balance due before delivery
Work will begin only after the deposit is received.
4. Modifications During the Production Process for Commissioned Artworks
Reasonable modifications are included in the price up to a certain number of revisions before the final phase begins. Further or substantial modifications requested after approval of the draft will be subject to additional charges.
5. Delivery and Shipping
Delivery will be made by courier to the address provided by the Customer/Commissioner, only after the full payment has been processed. The Customer cannot request delivery to P.O. boxes or similar addresses.
Shipping costs and estimated delivery times will be calculated and communicated at the time of order confirmation for ready-to-ship products, and upon completion of the commissioned artwork for custom orders.
The Customer/Consumer must notify the Seller/Artist of any delays in delivery exceeding 4 working days after the expected delivery date via the "Contact" page in the Customer Service area of the Site. In the case of lost goods, the Seller/Artist will not be able to guarantee a replacement for unique items and will provide a refund via bank transfer to the account details provided by the Customer.
If it becomes impossible to fulfill the order due to force majeure, the Seller/Artist will notify the Customer/Commissioner by canceling the order and refunding any payment received.
6. Right of Withdrawal
With the exception of commissioned artworks, the Customer has the right to withdraw from the contract (under Article 65 of the Italian Consumer Code, Legislative Decree No. 206/2005) by sending an email to contact@ameliestudio.it
within 14 days from the receipt of the product, stating:
The intention to exercise the right of withdrawal
The product in question
The order number
Bank account details (bank name, agency, account number) or postal account information
To obtain a refund, the Customer must return the product within 14 days, in perfect condition, in its original packaging, with authenticity certificates, and all received documentation. The product must not be damaged, soiled, altered, or used improperly. If the returned item is damaged, incomplete, or used in a manner inconsistent with ordinary care, it will not be accepted for return.
Once the return is received and the product’s integrity is verified, the Seller will refund the Customer via bank transfer to the account details provided by the Customer in the withdrawal notice. Return shipping costs are the responsibility of the Customer.
In the case of returning a damaged, incomplete, deteriorated, or improperly used item, the Customer will be charged for the corresponding reduction in value of the item. The Seller/Artist will promptly notify the Customer of any damages or discrepancies discovered upon receiving the returned goods. The amount charged to the Customer will not exceed the original purchase price.
Returns of goods from unidentified individuals or without order reference will be held by the Seller/Artist for 60 days, after which they may be disposed of at the Seller/Artist’s discretion.
According to Article 59, paragraph 1, letter c) of Legislative Decree No. 206/2005, the right of withdrawal does not apply to custom-made or personalized items. The Commissioner acknowledges this exclusion at the time of order.
7. Copyright and Image Rights
The Artist retains all copyright on the work, including but not limited to:
Reproduction, publication, and public communication
Exhibition
Use in portfolios, websites, social media, exhibitions, and catalogs
The sale only concerns the material ownership of the work (original or reproduction), not the transfer of economic exploitation rights.
The Customer/Commissioner may display the work in private and on their own social media only for personal, non-commercial purposes, always citing the Artist (e.g., “Work by Amélie Gaët”).
8. Prohibition of Use of Images for AI Training – Opt-out
The Customer/Commissioner and third parties accessing the work through the Customer/Commissioner are prohibited from using, reproducing, or uploading the image of the artwork, in whole or in part, for:
AI model training, optimization, or testing
Inclusion in public or private datasets
Automated data collection systems (scraping)
The Artist explicitly exercises their opt-out from any use of the work in relation to AI systems or models, except with written permission.
9. Warranty
The Seller/Artist creates works in a craft-based manner, which adds value to the work. The Seller/Artist cannot guarantee an exact match between the actual product and the image or colors as they appear on the Customer’s monitor. For commissioned works, the Seller/Artist also cannot guarantee an exact match between virtual drafts viewed on the Customer’s monitor and the final product.
Minor variations from the standards do not constitute defects but are a natural characteristic of this type of product. The warranty covers material defects or evident errors regarding the agreed-upon specifications (e.g., size, technique, presence of damages). It does not cover:
Minor artistic variations
The Artist’s creative interpretations
The Seller/Artist will not be responsible for any alterations over time. The Commissioner must report any defects promptly, within 8 days of discovery, to contact@ameliestudio.it
. The Artist will respond within 14 working days.
10. Limitation of Liability
The Seller/Artist shall not be held responsible for any damages of any nature or loss of profits suffered by the Customer/Commissioner due to the failure to fulfill a confirmed order or the non-delivery of products.
11. Privacy and Personal Data Protection
The collection and processing of personal data are carried out for the management and execution of current and future purchase orders, and in particular, to fulfill the obligations arising from these General Terms and Conditions of Sale. A copy of the Privacy Policy is available on the Site.
12. Applicable Law and Jurisdiction
The contract is governed by Italian law.
For disputes involving the Customer/Commissioner who is a consumer, the competent jurisdiction is the court of their place of residence or domicile.
